Allahabad HC rejects PIL seeking Holiday on ‘Karwa Chauth’

While rejecting PIL to grant Holiday on Karva Chauth, this year, the division bench of Justices Attau Rahman Masoodi and Om Prakash Shukla of the Allahabad High Court said that declaration of holidays falls in the realm of policy matters of the state.

 ‘’The courts cannot entertain such disputes unless guided by statute. Even otherwise festivals are commonly celebrated by all.’’ The bench said.

The petitioner's counsel has presented the argument that the festival of Karwa Chauth is predominantly observed by women, and there appears to be gender discrimination in the context of declaring holidays for festivals

The bench noted that the writ petition for such a cause is misconceived and cannot be entertained in the public interest.

In view of the above, the bench rejected the petition.
