Allahabad HC: Gyanvapi case hearing adjourned till November 8

The Allahabad High Court has postponed the hearing until November 8 for a petition submitted by the Anjuman Intezamia Masjid Committee (AIMC). The petition challenges the suitability of a lawsuit that seeks to restore a temple at the location where the Gyanvapi mosque currently stands in Varanasi.

In the proceedings, the AIMC informed the court that they had submitted a Special Leave Petition (SLP) to the Supreme Court. This SLP challenges the order issued by the chief justice of the high court to transfer the case from a single-judge bench that had been handling it since 2021. 

The Chief Justice, Pritinkar Diwakar, was informed that the apex court had scheduled a hearing for November 6 regarding this matter. Consequently, the hearing on AIMC's request was postponed until November 8.

The AIMC has contested the suitability of a lawsuit that was filed in a Varanasi court. In this lawsuit, the plaintiff sought the restoration of a temple at the location where the Gyanvapi mosque currently stands.

The petition also raises objections to a directive issued by a Varanasi court, which instructed the Archaeological Survey of India (ASI) to carry out an extensive survey of the Gyanvapi mosque. This order was issued on April 8, 2021.

The Chief Justice, in explaining the rationale behind the order dated September 18, 2023, which is now being contested in the Supreme Court, mentioned that the decision was made on the administrative side to uphold principles such as judicial propriety, judicial discipline, and transparency in the listing of cases.
