A man charged with violating the Uttar Pradesh Prevention Of Cow Slaughter Act, 1955, was granted bail on December 23 by the single bench of the Allahabad High Court, presided over by Justice Shree Prakash Singh, on the condition that he deposit Rs. 10,000 into the account of Gau Seva Aayog within one month of his release.
The bench made this decision while considering the bail motion made by Saleem, who had been arrested for violating Sections 3/8 of the Cow Slaughter Act of 1955.
His attorney argued before the court that the man is innocent and that the current case has wrongly accused him. Further, it was claimed that the applicant's name appeared solely on the confessional statements of the other co-accused parties in the FIR and that he was not immediately apprehended.
Additionally, it was stated that the police had ensnared him in the current investigation and that there was not solid evidence to link him to the current case.
Finally, it was claimed that he has been imprisoned since September 30, 2022, is not engaged in any anti-social behaviour, and is not a member of any gang. If bail is granted, he will cooperate with the court proceedings and not abuse his freedom. He also committed to put Rs. 10,000 into the UP Gau Sewa Aayog's account.
In light of all of this, the Court decided that it was reasonable to increase his bail after hearing from the parties' attorneys and made the findings that: "...I find that applicant has been enlarged on bail in the case mentioned in the gang chart and some other cases depicted against the applicant in which also he has been enlarged on bail, coupled with the fact that he is languishing in jail since 30.09.2022, thus without commenting on the merits of the case, I find it a fit case for bail. Further applicant is ready to deposit Rs.10,000/- in the accounts of Gau Seva Aayog."
It should be noted that the Allahabad High Court granted bail to a man charged under the UP Prevention Of Cow Slaughter Act, 1955, in June of this year, with the stipulation that he feed the cows for a month in Gaushala after being let out of jail.
