Allahabad HC conducts Holiday Hearing, Saves Student's Semester in Attendance Battle

Allahabad High Court has given a big relief to student Sanya Yadav, who was debarred from appearing in the examination by Amity University of Noida due to low attendance. She will be able to appear in the supplementary examination to be held on Thursday 16 November. The MBA (Media Management) student filed a petition on Wednesday and prayed for an immediate hearing. During the course of hearing, she submitted thatthe attendance had reduced due to technical reasons.

If she fails, she is ready to pay heavy compensation, but if she is not allowed to appear in the exam, six months of her time will be wasted.

Despite the holiday, the court of Chief Justice Pritinkar Diwakar sat at 3:30 in the day. The court directed to allow student Sanya to appear in the supplementary examination to be held on November 16 from 2 pm and said that the examination result will not be declared without the permission of the court.

On Wednesday, advocate Avnish Tripathi filed a petition in the Registrar General's office and demanded an immediate hearing, saying that the matter was urgent. On this, the Chief Justice himself sat for the hearing considering the future of the student. The petitioner says that he has done every class. His attendance is 100% but due to less attendance being shown in the portal, he has not been allowed to appear in the examination.

If she does not appear for the exam, six months of her time will be wasted. If it fails, it is ready to pay huge compensation to the university. The state government's advocate said that the matter is between the university and the student, he has no role in it.

Counsel for the University said that due to the closure of the office today, he has not received complete information, but there has been so much delay that the admit card cannot be issued now.

The court said, every examination is important for the student. Considering the documents and adverse circumstances, the court directed to allow her to appear in Thursday's examination. The court also said that if the petitioner's contention is not found true then it will pay compensation to the university.

The next hearing in the case will be on December 14.
