AAP MP Sanjay Singh appeals to SC for bail in money laundering case

Aam Aadmi Party (AAP) Rajya Sabha MP Sanjay Singh has moved the Supreme Court seeking bail in connection to the money laundering case registered by the Enforcement Directorate (ED) related to the Delhi excise policy scam. The move comes after the Delhi High Court rejected Singh's bail plea on February 9, 2024, directing the trial court to expedite the proceedings.

Sanjay Singh was taken into custody by the Enforcement Directorate on October 4, 2023, following a search at his residence. Subsequently, he has been in judicial custody since October 13, 2023. The trial court had denied his bail plea on December 22, 2023, prompting Singh to approach the Delhi High Court.

The case against Singh alleges his pivotal role in formulating and implementing the now-abandoned Delhi excise policy, which purportedly aimed to benefit specific liquor manufacturers, wholesalers, and retailers. The rejection of his bail plea by both the trial court and the High Court has now led Singh to seek relief from the Supreme Court.

Notably, the Delhi High Court, while dismissing Singh's bail application, emphasized the need to expedite the trial and discouraged unnecessary adjournments. The court stated, "No ground for grant of bail is made out. We direct the trial court to expedite the trial. No unnecessary adjournment be sought by either side."

This legal battle took a prior turn when Singh had initially challenged his arrest, contending that it was an abuse of the legal process and violated the Supreme Court's verdict in the Pankaj Bansal v. Union of India case, also known as the M3M Reality case. However, the High Court rejected this plea on October 20, 2023, asserting that the ED is a premier investigating agency, and imputing political motives to it may adversely impact the country's image.

In response, Singh moved the Supreme Court on this matter, which is still pending before the apex court. During the hearing on November 20, 2023, the Supreme Court granted him the liberty to approach the trial court for bail. However, both the trial court and the Delhi High Court have maintained their stance against granting bail, leading to Singh's current appeal before the Supreme Court.
