AAP MP Raghav Chadha challenges eviction order in Delhi High Court

Aam Aadmi Party (AAP) Member of Parliament (MP) Raghav Chadha has taken legal action by filing a petition in the Delhi High Court. He is challenging a previous decision made by a Delhi district court, which had given approval for the Rajya Sabha Secretariat to remove him from the government-allocated residence he had been residing in.

Today, Advocate Warisha Farasat presented the plea before a Bench consisting of Chief Justice Satish Chandra Sharma and Justice Sanjeev Narula. The Bench stated that the case will be scheduled for listing tomorrow.

On October 5th, the Patiala House Court reversed its previous order, which had prohibited the Rajya Sabha Secretariat from removing Raghav Chadha from his government-provided residence.

Additional District Judge Sudhanshu Kaushik noted that Raghav Chadha does not possess a guaranteed or vested right to maintain occupancy of the bungalow, as it was provided to him as a privilege due to his status as a Member of Parliament (MP).

In September 2022, Raghav Chadha was assigned a Type-VII accommodation bungalow located at Pandara Road in Delhi. However, in March of the following year (2023), he received notification that this allotment had been canceled on the grounds that Type-VII exceeded his entitlement. As a result, he was allocated a different flat.

Raghav Chadha requested a permanent injunction to prevent the cancellation of his allotment for the Pandara Road bungalow. On April 18, the Patiala House Court granted him interim relief in this matter.

The order granting interim relief to Raghav Chadha, which was issued on April 18, was later revoked on October 5. This revocation occurred following a review requested by the Rajya Sabha Secretariat. They argued that the interim relief had been granted without following the procedure outlined in Section 80(2) of the Civil Procedure Code (CPC) because leave to institute the suit had not been granted.
