Recently, the Chhattisgarh High Court quashed an advertisement issued by the State Public Service Commission (PSC) and held that giving 100% Reservation to Women in the job Sector is totally against the Fundamental Rights of a person given under the Constitution of India.
The division bench of Chhattisgarh High Court Chief Justice Arup Kumar Goswami and Justice N K Vyas dismissed regulations drawn up by the State government that specified only female candidates to be entitled the recruitment to the posts of professors, principals and demonstrators in the government nursing colleges.
Earlier, the Chhattisgarh High Court sought a response from the State Government, the State Government informed that since the recruitment needs to be done in the college, where only the women candidates can take admissions, and therefore arrangements were put in place to facilitate women academicians teaching female students.
Later, in December 2021, Public Service Commission (PSC) issued an advertisement for 91 posts and quoted the government’s provisions of law while inviting applications only from women.
Senior Dr Ajay Tripathi, Alyus Xalxo, A K Kispotta and others moved to the Chhattisgarh High court challenging recruitment directions of only females in government jobs. Counsel Member Advocate Ghanshyam Kashyap and Nelson Panna pointing to Clause-5 (women only eligible) in the advertisement, stated that it violates Articles 14, 15, and 16 of the Constitution.
