MAHARASHTRA: In the matter of State v. Rouf Khan, the Malegaon Court ordered a Muslim Man to offer Namaz 5 times a day and plant 2 Trees. The court convicted him in the Road Accident Case.
The bench was held by Tejwant Singh Sandhu, who observed that Section 3 of the Probation of Offenders Act of 1958 give power to the Magistrate to release the convict after giving the warning.
The court further added that it is important that the convict remembers the warning and his conviction so that he does not repeat his acts.
Court observed,
“According to me, giving appropriate warning means, to give an understanding that the crime had been committed, the accused has been proven guilty and he remembers the same so that he does not repeat the offence again,”
During the hearing, the accused (30 yrs age) said that despite being a man following the Islamic faith, he was not offering regular Namaz as stipulated in the Muslim religious texts.
The accused was charged in the year 2010 under Sections 323 (voluntarily causing hurt), 325 (voluntarily causing grievous hurt), 504 (intentional insult to provoke breach of peace) and 506 (criminal intimidation) of the Indian Penal Code.
While the Magistrate held that Khan was guilty under Section 323, he was acquitted of the remaining offences.
