In a recent development, the Tripura High Court has reassigned Civil Judge Biswatosh Dhar from his position in the Kamalpur subdivision due to accusations of sexual harassment made by a survivor of rape.
The alleged incident took place in his chamber while the woman was giving her statement on February 16. The woman, who had come to record her statement in a rape case, accused the first-class judicial magistrate of groping her. After the distressing experience, she reported the incident to the Additional District and Sessions Judge in Kamalpur.
The woman asserts that the incident caused immediate distress, prompting her to swiftly leave the chamber and notify both the present lawyers and her husband. Subsequently, her husband filed a separate complaint with the Kamalpur Bar Association.
In response to the accusations, the Tripura High Court issued a notification on February 23, announcing the transfer of Sri Biswatosh Dhar, Civil Judge (Jr. Div.)-cum-Judicial Magistrate First Class, Kamalpur, Dhalai District, to the High Court and placing him on compulsory waiting for future posting. This action underscores the judiciary's acknowledgment and handling of the serious allegations leveled against him.
In addition to the transfer, given the gravity of the accusations, the High Court has initiated an investigation led by a three-member panel chaired by District and Sessions Judge Gautam Sarkar. The objective of this investigation is to collect evidence and establish the appropriate course of action in the case.Meanwhile, the civil judge has been placed on compulsory waiting for future postings, and his duties have been reassigned to Smt. Madhumita Biswas, as outlined in the notification.
The civil judge has also been instructed to report to the High Court promptly.
