Supreme court will hear the appeal against acquittal of SN Saibaba on Saturday

The Supreme Court will function tomorrow Saturday the 15th October, 2022 at 11 AM to hear a petition filed by the State of Maharastra challenging the acquittal of Prof. G.N. Saibaba in UAPA Case. The matter is listed before the Court of Justices MR Shah and Bela M Trivedi in Court no. 2 as item no. 301 in a special bench.

Bombay High Court at Nagpur Bench allowed the appeal of GN Saibaba and others and acquitted them in a UAPA Case over alleged links with Maoist organizations. The ground of setting aside the judgment of the trial court and acquittal of the former Delhi University Professor and others was held to be a trial without valid sanction under section 45 of the Unlawful Activities Prevention Act. 

The Trial Took place against 6 persons including Sai baba but one of the accused Pandu Pora died, therefore, the High Court ordered the immediate release of accused persons Saibaba, Mahesh Tirki, Hem Keshwdatta Mishra, Prashant Rahi and Vijay Nan Tirki. They all were convicted for life imprisonment by the Trial Court for the offence committed u/s 13, 18 20, 38 and 39 of UAPA and 120B IPC.

SG Tushar Mehta, for the Union of India, made a mentioning before the court before the bench of Justice DY Chandrachud who was sitting and hearing cases in court-room after normal working hours. The request for listing was allowed.
