Sukesh Chandrashekhar's petition for transfer to jail outside Delhi, dismissed by Supreme Court

The Supreme Court dismissed a writ petition filed by Sukesh Chandrashekhar and Leena Paulose seeking their transfer from Mandoli jail to any other jail where the current Director General (Prisons) of Delhi is not in charge. A bench comprising Justices Ajay Rastogi and CT Ravikumar refused to entertain the petition and held that "We are not inclined to grant the prayer of transfer. Dismissed."

Both these petitioners were transferred from Tihar Jail to Mandoli Jail in Delhi on 26 August 2022 as a result of the Supreme Court's order on 23rd August. Sukesh had filed a writ petition under Article 32 of the Constitution of India, alleging that officials in Tihar were torturing him for failing to meet their financial demands. The Enforcement Directorate had denied the allegations, claiming that Sukesh was running his extortion ring from behind bars with the help of certain officials, against whom action had been taken.

That order was issued after Chandrasekhar had filed a petition in the Supreme Court for transfer to another jail, preferably outside of Delhi, alleging that some Tihar prison officials were endangering his life and safety.

Sukesh's advocate argued before the bench of Justices Ajay Rastogi and CT Ravikumar that he was assaulted in jail and that he is being asked to pay a hefty sum of Rs. 25 lakh. However, the court dismissed these concerns, stating that "After the matter being considered by this Court on August 23, the petitioner was shifted on August 26. In a short span, he has come again with the present writ petition seeking transfer from Mandoli jail to any other jail which is not within the control of the present DG (Prisons). For this grievance, we find no reason to entertain the present petition seeking transfer of jail."

Chandrashekhar was arrested for extortion, as well as money laundering. In July, the Supreme Court ordered the imprisoned Sukesh Chandrashekhar to reveal the names of Tihar jail officials to whom he paid over 12.5 crores to secure a lavish lifestyle inside the jail.
