Recently, the Supreme Court denied a request from the Punjab government to access the statements given by witnesses before the Justice Indu Malhotra Committee, which investigated the security lapses during Prime Minister Narendra Modi's visit to Punjab in January 2022.
"We see no ground to entertain the request made by Punjab government. The state may conduct its enquiry without the aid of the statements made by the witnesses before the enquiry committee," observed a bench comprising Justice Surya Kant and Justice Ujjal Bhuyan.
In January 2022, a Supreme Court bench led by then Chief Justice of India (CJI) NV Ramana appointed Justice (Retd.) Indu Malhotra as the chairperson of a court-ordered committee to investigate the security breach during Prime Minister Narendra Modi's visit to Punjab. The committee was to include the DG of Police (Chandigarh), the Additional DGP (Punjab), the Registrar General of the Punjab and Haryana High Court, and an official from the National Investigation Agency (NIA).
On January 7, 2022, the Supreme Court directed the committees formed by both the Punjab and Central governments to halt their operations regarding the security breach investigation.
A petition had been filed before the Court, referencing reports from the media and the Press Information Bureau of the Central Government. The plea raised concerns that the breach was intentional, posing serious questions regarding national security and the role of the current political leadership in Punjab.
It further stated that the, "situation wherein a high constitutional functionary is stranded on a flyover is an extremely high security threat considering the vulnerability and the degree of planning and protection required for the office of the Prime Minister."

The plea has further alleged, "what was shocking and alarming on many levels was that local Police personnel on the spot were seen to be participating with the hooligans who jeopardised the security of the Prime Minister."
The plea has requested the suspension of Punjab's Chief Secretary, Anirudh Tiwari, and Director General of Police, Sidharth Chattopadhyay, while urging the Central Government to initiate departmental action against them.
