SC Collegium Approves Justice Sujoy Paul's Transfer Request Amid Conflict of Interest Concerns

The Supreme Court's collegium has approved Justice Sujoy Paul's request for transfer from the Madhya Pradesh High Court to another court. Justice Paul made the request on February 12th, citing concerns over his son practicing in the same High Court.

Following this decision, the Supreme Court issued a notification yesterday (February 13th), officially transferring Justice Paul to the High Court of Telangana. The notification states that the transfer was made "in the interests of the better administration of justice."

“By a communication dated 12 February 2024, Mr Justice Sujoy Paul has sought a transfer on the ground that his son is practicing in the High Court of Madhya Pradesh. The Collegium accedes to the request and resolves to recommend that Mr Justice Sujoy Paul be transferred, in the interests of the better administration of justice, to the High Court for the State of Telangana.”

Additionally, it is noteworthy that the Collegium has also approved Justice Moushumi Bhattacharya's request for transfer to another court. She too has been transferred to the Telangana High Court, as indicated by a separate notification.

The collegium members signed the notification, i.e., CJI Dhananjaya Y Chandrachud, Justices Sanjiv Khanna, B R Gavai, Surya Kant, and Aniruddha Bose.
