PIL urges Top Court to intervene in Sandeshkhali sexual assault allegations

In the wake of disturbing reports of sexual assault in Sandeshkhali, West Bengal, a Public Interest Litigation (PIL) has been filed in the Supreme Court, urging judicial intervention into the matter. Advocate Alakh Alok Srivastava, representing the petitioner, has brought attention to the alleged complicity and dereliction of duty on the part of the West Bengal police, particularly implicating Trinamool Congress leader Shajahan Sheikh.

The petitioner's allegations stem from a series of troubling events, including an attack on officials of the Enforcement Directorate during a raid on Sheikh's house, leading to his subsequent disappearance. Following Sheikh's departure, a group of women, predominantly from marginalized communities, came forward to protest against the alleged sexual assault and atrocities reportedly committed by Sheikh and other TMC leaders.

Expressing concerns over the potential bias and influence within the state police force, the PIL requests the transfer of the investigation to the Central Bureau of Investigation (CBI) or a Special Investigation Team (SIT), under the monitoring of the Supreme Court. Additionally, the petitioner seeks the relocation of the trial outside of West Bengal, citing fears of interference and lack of impartiality.

The PIL also calls for compensation for the victims and accountability for any lapses on the part of law enforcement officials. Advocate Srivastava draws parallels with previous Supreme Court orders related to similar cases of public importance specifically related to cases like the Manipur violence, emphasizing the need for swift and impartial action.

While the Supreme Court has not yet taken concrete action on the matter, Chief Justice of India DY Chandrachud has agreed to examine the petition for urgent listing. The development comes in the wake of the Calcutta High Court's decision to suo motu take up the issue, indicating the severity of the allegations and the urgency for judicial scrutiny.
