Jharkhand High Court directs JPSC to release revised results in two months

Recently, the division bench of Justice SN Prasad and Justice Navneet Kumar of Jharkhand High Court has directed JPSC to release the revised result of Assistant Town Planner appointment interview within two months. While giving its verdict in this regard on Saturday, the court directed JPSC to cancel the candidature of such people.

Who did not have the certificate of Institute of Town Planner of India (ITPI) till the last date of submission of application (10 August 2020). Instructions have also been given to cancel the applications of 186 candidates who were called for interview. Who had appeared in the interview despite not having the certificate. The court has asked JPSC to form a new panel and release the revised results. Those who had ITPI certificate till the last date of application. The court clarified that no already working officer will be included in the panel.

The High Court said - Government should pay attention, so that the dignity of JPSC is maintained, the Commission worked beyond its jurisdiction. Those who did not have certificates were also selected in the interview, such people will be out of the list.

The Chairman should fix the responsibility of the officer who committed the mistake. The court made several sharp remarks in its order. The court said that in this case JPSC acted beyond its jurisdiction. Due to which there has been a delay in appointment. JPSC has violated the rules by unfairly including candidates in the examination.

Eligible candidates have to face problems due to this mistake of JPSC. Due to the town planner not being appointed on time, the work of the people of the state has also been affected. The court has said in its order that the JPSC Chairman should fix the responsibility of the officers for this mistake. Also, the court told the government that it should pay attention to this, so that the respect of a constitutional institution like JPSC is maintained.

In the examination for the appointment of Assistant Town Planner, 26 candidates without certificates were selected. This result was challenged in the court, arguing that it violated the rules. This matter had earlier gone to the single bench. The single bench had rejected the petition, saying that the decision of JPSC was correct. After this, an appeal petition was filed in the division bench. Petitioners Vivek Harsil, Swapnil Mayuresh and others had filed a petition in the division bench challenging the order of the single bench.

On the government's argument of canceling the entire examination, the petitioner's lawyer said that the government is taking such a decision to cover up the mistakes of JPSC. If JPSC has violated the rules, then there is no justification to cancel the appointment process. Senior advocate Ajit Kumar had said that 26 such candidates have been successful in the examination for the appointment of Assistant Town Planner,In the advertisement, only those who had certificates till the last date of application were said to be eligible to apply, but when the results were released, 26 candidates without certificates were selected in the merit list.

Senior advocate Ajit Kumar had told the court that giving proof of ITPI was a mandatory qualification for appointment, but the said candidates gave misleading information. In such a situation, they cannot be given this benefit. Successful candidate Kumar Chetan had also filed a petition in this matter who did not have the registration certificate of the Institute of Town Planner till the last date of filling the application.

Senior advocate Ajit Kumar had said that 26 such candidates have been successful in the examination for the appointment of Assistant Town Planner, who did not have the registration certificate of the Institute of Town Planner till the last date of filling the application.
