Have no authority to issue directions to the Pakistan government : Supreme Court.

Today, the Supreme Court has refused to take up the issue of arrested Indian fishermen who were detained after straying into Pakistan's waters.

The court ordered that political matters will be resolved politically. The Supreme Court stated that it cannot issue directions to Pakistan for the release of such fishermen, and the determination of this matter cannot be made in the writ petition under Article 32 of the Constitution.

Article 32 of the Constitution grants Indian citizens the right to directly approach the Supreme Court to enforce their fundamental rights through appropriate remedies.

The division bench of Justice Sanjay Kaul and Justice Sudhanshu Dhulia's bench asked the presenting counsel on behalf of the petitioners, 'Is it to be determined in Article 32 writ petitions? How will Pakistan and India resolve the issue of their fishermen? Should we issue directions to Pakistan in Article 32 writ petitions? Can we instruct them to release them?'

Case Brief -

The bench was hearing a Public Interest Litigation (PIL) filed by three petitioners, two from Gujarat and one from Maharashtra. The petitioners lawyers had demanded the revival of a judicial committee comprising judges from India and Pakistan, which was established in 2008 to mutually resolve issues, including the matter of fishermen who were arrested for straying into each other's maritime territories.

The bench remarked, 'What is the situation today? What are the relations with the country today? These are government issues. Political matters will be resolved politically.' The petitioners were advised to contact the government
