Gujarat HC Expresses Shock Over Allegations of Rape, Discrimination, and Favoritism at GNLU Gandhinagar

Today, the Gujarat High Court conveyed its shock in response to revelations of rape, molestation, discrimination, homophobia, and favoritism at Gujarat National Law University (GNLU), Gandhinagar. These distressing findings were detailed in a report submitted by a fact-finding committee.

A bench comprising Chief Justice Sunita Agarwal and Justice Aniruddha Mayee strongly criticized the GNLU administration for its previous assertions that no untoward incidents had occurred at the law school.

The report was submitted by the committee chaired by former High Court judge Justice Harsha Devani. This committee had been formed to investigate allegations of sexual harassment and homophobia at GNLU, following revelations in a news report. The committee had been reconstituted pursuant to an order in a suo motu public interest litigation (PIL) initiated by the High Court. This action followed allegations reported in the Ahmedabad Mirror last year, including the rape of one student and harassment of another queer student at GNLU.

Today, the Court lauded the committee for being categorical in its findings and for doing a "tremendous job". On the revelations made in the report, the Court said,

Questioning how such incidents can take place at a national law university, the Court recalled that the GNLU Registrar had earlier filed an affidavit denying the allegations and urging the Court to close the suo motu proceedings.

He had the audacity to say this in the court when the court is seized with the matter. How will these people protect the children?” Chief Justice Agarwal asked.

The Court also noted that the difficulty for students in coming forward to speak about the incidents was evident, as the committee had to resort to providing a questionnaire to facilitate gathering their responses. The Court proceeded to observe that the names of the accused had been disclosed, along with a definitive assertion that a politically influential individual was implicated in suppressing the case before the police. Additionally, the Court affirmed that it had no grounds to doubt the veracity of the students' accounts. Emphasizing the necessity for a thorough investigation into the operations of GNLU and its faculty, the Court urged Advocate General (AG) Kamal Trivedi to propose an appropriate authority that should be tasked with taking action based on the report. At the conclusion of today's hearing, Chief Justice Agarwal also conveyed her particular concern for the students, who are destined to become the upholders of the law in the future.

The matter will be heard next on March 12.
