Today, the Delhi High Court dismissed the plea by Bibhav Kumar, who challenged his arrest in the Swati Maliwal assault case.
The single headed bench of Justice Neena Bansal Krishna denied relief to Kumar, an aide to Delhi Chief Minister Arvind Kejriwal. Kumar faced allegations of assaulting Maliwal at the CM's official residence and sought the High Court's intervention to declare his arrest illegal and to receive compensation.
He requested the High Court to declare that his arrest violated the guidelines established by the Supreme Court in the Arnesh Kumar judgment.
Kumar was arrested by the Delhi Police on May 18 and was initially remanded to police custody for five days. On May 24, he was transferred to judicial custody.
Maliwal, a leader of the Aam Aadmi Party (AAP), alleged in the FIR that Kumar assaulted her by striking her in the chest, stomach, and pelvic area during a visit to the Chief Minister's residence.
The Aam Aadmi Party (AAP) has refuted the MP's allegations, accusing her of conspiring against the political party.
Earlier, social media videos emerged showing Maliwal engaged in a heated argument with security personnel and leaving the Chief Minister's residence on the day of the alleged assault.
Kumar has been denied bail by both the Delhi High Court and the trial court. His bail plea is now awaiting a decision from the Supreme Court.
