On Wednesday, the Delhi High Court received assurance from the Central government that it would ensure the provision of necessary medical care to Yasin Malik, the convicted Kashmiri separatist leader, whenever needed.
Advocate Rajat Nair represented the Union government before Justice Anoop Kumar Mendiratta, and his statement was duly recorded by the Court.
“Learned counsel for the respondent (Union of India) submits that they are duty bound to provide necessary medical treatment to the petitioner (Malik) as and when required in accordance with law,” the Court recorded in its order.
Subsequently, the High Court resolved the plea filed by Malik, who had approached the Court seeking directives to transfer him to the All India Institute of Medical Sciences (AIIMS) for treatment of cardiac and kidney ailments.
During the last hearing, the Court had requested the government submit a status report regarding the matter.
Today, while representing the government, Nair informed the Court that on February 13, Malik reported feeling dizzy. Subsequently, he was examined by prison doctors, who found that he had voluntarily ceased taking his prescribed medications.
Following this, he was promptly transferred to AIIMS, where he received the necessary medical attention, as per the information presented to the Court. Malik's counsel stated that they have no objection to the plea being disposed of if the government assures proper medical treatment will be provided to him.
Malik is currently serving a life sentence in a terror funding case and is incarcerated in Tihar jail. Meanwhile, the National Investigation Agency (NIA) has filed an appeal seeking the death penalty for him, which is pending before the Delhi High Court.
