On Wednesday, the Calcutta High Court granted permission to senior BJP leader Suvendu Adhikari to visit Haldarpara in the tense Sandeshkhali area on Thursday. Additionally, the court issued a stay on the imposition of Prohibitory Orders under Section 144 of the Criminal Procedure Code (CrPC) at Haldarpara.
Justice Kausik Chanda directed that the conditions for visiting the area would mirror those imposed by the high court during Suvendu Adhikari's previous visit to Sandeshkhali on February 20. Under the earlier order, Adhikari was instructed to submit an undertaking to the local police station, pledging not to engage in any activities that could exacerbate the law and order situation in the locality during his visit to the restive area.
Justice Chanda also halted the enforcement of Prohibitory Orders under Section 144 of the Criminal Procedure Code (CrPC) at Haldarpara within the Jeliakhali village panchayat on February 26. He noted that the concerned sub-divisional magistrate had imposed these orders in a "mechanical" manner without adequately verifying their justification. Suvendu Adhikari had previously visited the Sandeshkhali village panchayat area on February 20, as per the directive of the high court. Subsequently, he approached the court once more, requesting permission to visit Haldarpara.
In opposition to Adhikari's plea, the state's advocate general, Kishore Dutta, contended that Adhikari had breached the undertaking he provided during his visit on February 20.
