Calcutta HC Allows ED to File Contempt Petition Against WB Govt in Shajahan Sheikh Case

Today, the Calcutta High Court granted permission to the Enforcement Directorate (ED) to file a contempt petition against the West Bengal government. This action was taken due to the state police's failure to transfer custody of suspended Trinamool Congress (TMC) leader Shajahan Sheikh to the Central Bureau of Investigation (CBI), despite a court order directing them to do so.

Representing the Enforcement Directorate (ED), Deputy Solicitor General Dhiraj Trivedi requested permission to file the contempt petition and urged for an expedited hearing of the matter. Trivedi emphasized the importance of timely action, asserting that valuable time for Sheikh's custody with the CBI was being lost.

The High Court had issued a directive on Tuesday, instructing the transfer of the investigation into a mob attack on Enforcement Directorate (ED) officials. The attack occurred when the officials were conducting a search at the premises of Shajahan Sheikh in Sandeshkhali, North 24 Parganas district, on January 5. This search was related to a probe into a ration scam.

A division bench, consisting of justices Harish Tandon and Hiranmay Bhattacharyya, granted permission to the Enforcement Directorate (ED) to file the petition.

Today, the West Bengal government requested an urgent listing of its plea in the Supreme Court challenging the High Court's order to transfer the investigation into the attack on ED officials to the Central Bureau of Investigation (CBI).

A division bench, led by Chief Justice T S Sivagnanam, issued a directive on Tuesday, instructing the transfer of the investigation into the mob attack on Enforcement Directorate (ED) officials to the Central Bureau of Investigation (CBI). Additionally, the bench ordered that Shajahan Sheikh's custody be transferred to CBI officials by 4:30 pm on the same day.

Sleuths from the Central Bureau of Investigation (CBI) reportedly waited for over two hours at the CID headquarters in Bhavani Bhawan for Shajahan Sheikh's custody. However, they left without him after the state agency informed them that the West Bengal government had filed a plea in the Supreme Court regarding the matter on Tuesday evening.

Sheikh was arrested by the West Bengal Police on February 29 in connection with the attack on ED officials, following which the state government handed over the case to the CID.
