Bombay HC Quashes Summons to Delhi CM Arvind Kejriwal Over Alleged Model Code of Conduct Violation

Today, the Bombay High Court nullified the summons that had been issued to Delhi Chief Minister Arvind Kejriwal by a magistrate in Mapusa, Goa. These summons were related to a complaint filed by the Election Commission of India (ECI) accusing him of breaching the Model Code of Conduct back in 2017.

Although the Bombay High Court has granted temporary relief to Aam Aadmi Party National Convenor Arvind Kejriwal, the matter is not entirely resolved. The High Court has instructed the Magistrate to reconsider the case from the stage of summons, indicating that the legal proceedings will continue.

A detailed copy of the judgment passed by the division bench of Justices MS Sonak and Valmiki SA Menezes is awaited.

Advocate Amit Palekar, who serves as the Goa President of the Aam Aadmi Party (AAP), shared on X (formerly Twitter) that the issue revolves around a speech delivered by Arvind Kejriwal during the campaign for the 2017 Goa elections.
 
According to a report by the Hindustan Times, Arvind Kejriwal allegedly breached the model code of conduct during the election campaigning by urging voters at an election rally to accept cash from all political parties but to cast their votes exclusively for the Aam Aadmi Party (AAP). 

The summons by the Judicial Magistrate, First Class Mapusa, was reportedly issued last year on the complaint alleging violation of provisions of Representation of the People Act and the Indian Penal Code.
