Allahabad High Court directed the Ministry of Education and Ministry of Minority Affairs to submit their responses regarding the possibility of the state establishing statutory education boards that authorize religious education. This directive was issued during the plea hearing on Wednesday.
The bench, consisting of Justice Vivek Chaudhary and Justice Subhash Vidyarthi, observed that despite the Union Government submitting a response in compliance with a previous court order, it lacked a specific answer to the raised query.
Consequently, the division bench instructed the legal representatives representing the Union of India to obtain written instructions on the aforementioned matter from the relevant ministries. The court set a deadline for the responses to be presented before it by February 2, 2024.
"It is expected that both ministries will fully cooperate with the learned counsel for the Union of India, who shall advance his submissions before this court on February 2, 2024," ordered the court.
On December 7, 2023, the high court had requested explicit and specific policies and perspectives from the Union of India, the State Government, and the U.P. Madarsa Education Board regarding the appointment of individuals belonging to a particular religion as members of the Board.
The court emphasized that the administration of Madarsas significantly influences a substantial number of students in the country, impacting the quality of their education. Therefore, a clear stance from the governments involved was deemed essential by the court.
