Why Court Orders Teen Driver in Fatal Porsche Crash to Write Essay on Road Safety for Bail?

The Juvenile Justice Board (JJB) in Pune grants bail to a 17-year-old boy who was driving a Porsche at high speed when it hit a bike, resulting in the death of two people. Besides imposing the usual condition of parental monitoring of the juvenile, the JJB, in a unique condition, also directed him to submit a 300-word essay on road accidents after studying all the rules and regulations on traffic at the Regional Transport Office (RTO).

The conditions imposed on the teenager are as follows:

  • Parents must ensure that the juvenile will not engage in similar offenses in the future and steer clear of negative influences.
  • Parents are required to ensure the juvenile's presence before the board whenever necessary.
  • The teenager must visit the Regional Transport Office to study all traffic rules and regulations and deliver a presentation on the same to the JJB within 15 days.
  • He must compose a 300-word essay on the impact of road accidents.
  • The juvenile will spend 15 days assisting an RTO officer in studying traffic regulations and submit a report to the JJB within the same timeframe.
  • He is mandated to visit a de-addiction counseling center, and the counseling report must be submitted to the JJB.
  • The teenager must consult a psychologist and psychiatric doctor at Sassoon Hospital in Pune, with the report due within 15 days.

The juvenile, son of a prominent builder in Pune, collided his Porsche car with a motorcycle in the Kalyani Nagar area. Reportedly, the vehicle dragged one of the two individuals on the bike and ultimately halted after striking another two-wheeler and a car.

He was charged with rash and negligent driving, as well as causing harm by endangering the safety of lives and death by negligence under sections 304A, 279, 337, and 338 of the Indian Penal Code (IPC), in addition to provisions of the Maharashtra Motor Vehicles Act.

The juvenile was also booked under Section 304 (culpable homicide not amounting to murder) of the IPC and is likely to be tried as an adult. Media reports also indicate that the juvenile's father and the pub, which allegedly served liquor to the minor, were also booked by the police.

Within hours of the accident, the juvenile was brought before the JJB. His lawyer, Advocate Prashant Patil, argued that if released on bail, he would neither tamper with evidence nor attempt to abscond from the court's jurisdiction.
