Uttarakhand HC addresses PIL on Illegal Parking in Nainital's Internal Roads

Recently, the Uttarakhand High Court listened to a Public Interest Litigation (PIL) submitted by hotel proprietors and residents residing along the internal roads of Nainital city, encompassing areas like Snow View, Birla, Zoo Road, CRST College Road, and various other thoroughfares. The case focused on addressing the issue of unauthorized vehicle parking on these roads. 

Acting Chief Justice Justice Manoj Kumar Tiwari and Justice Pankaj Purohit, serving as the division bench, have summoned SSP Nainital to attend court on Friday, December 1, along with the traffic strategy concerning this issue. The court has firmly directed hotel proprietors to adhere to designated parking areas, emphasizing that their vehicles should be parked solely in these allocated spaces on the road.

After the court's stringent directives, the police took immediate action by clearing parked vehicles along Zoo Road, Birla Road, and even Mall Road. This intervention significantly eased the situation for the locals.

Shruti Joshi, former vice-president of the High Court Bar Association, has lodged a PIL highlighting the persistent issue of vehicle parking by hotel owners and local residents on inner city roads. This unauthorized parking on CRST Road, Zoo Road, Birla Road, Snowview, and others has been causing traffic congestion, especially considering that 45 percent of the city's population resides in this particular zone.

Heavy traffic congestion caused by hotel operators parking their vehicles on the roads has been severely impacting school children, employees, and pedestrians. This congestion is resulting in delays for individuals trying to reach their destinations. To mitigate this issue, it's imperative to issue strict directives to hotel operators, mandating them to utilize designated parking areas exclusively.

Additionally, managing traffic flow specifically on Birla Road for a period of two days would be beneficial, especially considering an imminent announcement of winter vacation in schools. This measure could significantly alleviate the traffic congestion and aid smoother movement for commuters during this time.

A memorandum was given to the SSP on behalf of the Hotel Association demanding removal of illegally parked vehicles in Ramje Hospital Road including Zoo Road. Hotel operators said that due to vehicles parked on the road, the ambulance route in Ramje Road is often being obstructed, due to which serious patients get delayed in reaching the hospital, but the police did not take any action.

Hotel Association President Digvijay Singh Bisht said that the police did not remove illegal parking on other roads including Zoo Road even after requesting.
