The Allahabad High Court has expressed grave concern over the frequent occurrence of fatal accidents during the transportation of materials such as bricks, sand, gravel, and ballast via tractor-trolleys. Urging action, the court has directed the state government to enact legislation mandating the use of tractor-trolleys solely for agricultural purposes.
Justice Shekhar Kumar Yadav issued this directive while denying bail to Sanjay, who stands accused in a fatal accident involving a tractor-trolley in the Araon police station area of Firozabad. Emphasizing the primary agricultural role of tractors, the court noted that they are commonly utilized for tasks such as plowing, sowing, harvesting, and transporting agricultural produce and seeds.
Unauthorized transportation of materials like bricks, sand, gravel, and ballast from tractors primarily intended for agricultural purposes is a common occurrence. Tractor-trolleys are frequently taken onto main roads and into markets, despite their large size causing significant hindrances to traffic flow. The design of tractor-trolleys limits their suitability for field use only, exacerbating congestion and increasing the risk of accidents and loss of life on roads.
Most of the people who do not have a driving license also drive tractor trolley. The court said that using registered tractor-trolley for non-agricultural purposes is a violation of the Central Motor Vehicles Act 1988 and the Uttar Pradesh Motor Vehicles Taxation Act 1998.
From time to time, the Transport Department also advises that tractor-trolleys should not be operated unnecessarily on main roads. In such a situation, the transport department is expected to curb such unauthorized tractor trolleys so that accidents and deaths due to tractor-trolleys can be avoided.
Along with this, it is also suggested that tractor-trolleys used for agricultural work should not be used for carrying grains but farmers should be motivated to use other goods carrying vehicles. If necessary, a law has to be made on this issue, then consider in this direction also.
Former MP Dhananjay Singh has filed an appeal in Allahabad High Court against the sentence of MP/MLA Special Court of Jaunpur. In the appeal, there has been a demand to cancel the punishment order and release on bail. Dhananjay Singh's appeal is likely to be heard next week.
