Supreme Court will hear the pleas of Gautam Navlakha tomorrow and the NIA in relation to his house arrest

On November 17, the bench led by CJI Justice D.Y. Chandrachud directed that two applications, one filed by activist Gautam Navalakha and another to be filed by the National Investigation Agency later that day, be listed before the bench led by Justice K.M. Joseph tomorrow.

Ms. Nitya Ramakrishnan, senior advocate appearing on behalf of Navalakha, mentioned the early listing of the application before a bench comprised of the CJI, Justice D.Y. Chandrachud, Justice Hima Kohli, and Justice J.B. Pardiwala. As the concerned judge (Justice KM Joseph) was sitting on a constitutional bench for the day, the matter was mentioned before the bench led by the CJI.

Mr. Tushar Mehta, Solicitor General of India, appearing on behalf of the NIA, stated that the investigating agency intends to file an application.

Initially, the Bench was inclined to list Navalakha's application tomorrow and NIA's application as soon as it was filed.

Mr. Mehta stated that if Navalakha's application is approved, NIA's application will be rendered ineffective. In light of this, he proposed filing the application during the day and asked the bench to grant him permission to file the NIA's application outside of regular business hours. He promised the bench that the application would be distributed by tomorrow morning.

The application is in response to the NIA's objections to the activist's house arrest order. Ms. Ramakrishnan stated that despite the fact that the order was issued on November 10th and the NIA was supposed to inspect the premises within 48 hours, they have yet to do so.
