Supreme Court Rebukes Advocate for Lack of Preparedness in Legal Aid Case

On Tuesday, the Supreme Court reprimanded an advocate for being unprepared while serving as the legal aid counsel in a case.

A division bench comprising Justice Sudhanshu Dhulia and Justice Ahsanuddin Amanullah also expressed disapproval of the advocate's repeated emphasis that it was a 'legal aid' matter.

"What is the requirement of saying that this is a legal aid matter? You have the same responsibility like any other case. Argue on merits," Justice Dhulia remarked.

During the course of hearing, when the advocate attempted to argue further, Justice Amanullah remarked that the advocate was entirely unprepared for the case, noting that because it was a legal aid matter, he had not "given his 100 percent" effort to it.

"I must tell you one thing that you've not given you 100 percent in this case. If this would have been any regular case, you would have given. However, in such cases you must give double your efforts. I really don't like this practice and I have always objected this. These are critical cases and you are not prepared at all," Justice Amanullah remarked.

The Court was hearing an appeal challenging a 2023 decision of the Chhattisgarh High Court, which had upheld the appellant's conviction for murder. Ultimately, the Court dismissed the case.
