A Division Bench of Justice Indira Banerjee and MM Sunderesh issued notice on the Bail Petition filed by the accused of Lakhimpur Khiri incident during the Farmers Agitation to the State Government. the order dated 26th July 2022 of the Allahabad High Court of Dismissal of Bail Petition was challenged before the Apex Court.

Senior Advocate Mukul Rohatgi appearing for the son of the Union Minister Ajay Mishra argued that the person who had stated that he had seen the accused opening fire later stated that he is not an eye witness to the incident. It is also noteworthy to see that earlier when the Allahabad High Court granted bail to Mishra was set aside by the Apex Court and remanded the bail application back to the High Court.
