SC Halts P&H Court Order to Open Road Outside CM's Residence

On Friday, the Supreme Court issued a stay on a directive from the Punjab and Haryana High Court aimed to open the road outside Punjab Chief Minister Bhagwant Mann's residence to the public.

Justices Sanjiv Khanna and Dipankar Datta, presiding over the bench, have issued a notice to the Union Territory of Chandigarh. They have also placed a stay on the High Court's directive to open the road outside Punjab Chief Minister Bhagwant Mann's residence on a trial basis.

Following unified opposition from both the Union Territory of Chandigarh and the State of Punjab against the High Court order, Justices Sanjiv Khanna and Dipankar Datta issued a notice and stayed the directive to open the road outside Punjab Chief Minister Bhagwant Mann's residence for trial purposes.

The apex court ordered, "Issue notice. Direction regarding the opening of the road on a trial basis is stayed until further orders. However, the proceedings of the writ petition before the High Court may continue."

Solicitor General (SG) Tushar Mehta, representing the Chandigarh administration, expressed concern that the decision could potentially have severe repercussions on an individual's safety and well-being.

"This is playing with somebody's life," SG said.

"Unfortunately in recent years there is resurgence of terrorism. Grenades were thrown at our intelligence building," Punjab Advocate General too weighed in.

"Roads will not protect from that," the Court remarked.

However, the Solicitor General objected to specific observations made by the High Court concerning intelligence reports.

The High Court's assertion that intelligence reports are a figment of imagination is concerning," remarked the Solicitor General.

"Yes, those observations were indeed unwarranted," the top court agreed.

However, it said that public cannot be inconvenienced.

Nevertheless, it proceeded to stay the order.
