Karnataka HC Grants Interim Relief to Wing Commander Shiladitya Bose in Road Rage Case

The Karnataka High Court has granted interim relief to Wing Commander Shiladitya Bose by restraining the Bengaluru police from taking any coercive action against him in connection with a recent road rage incident.

Justice Hemant Chandanagoudar, who passed the order, also directed the police not to summon Bose without following due legal procedures, according to reports.

The incident took place on Monday on Old Madras Road in East Bengaluru, where Bose and Vikas Kumar SJ, an employee of a Business Process Outsourcing (BPO) firm, were involved in a physical altercation. Initial accounts indicated that Kumar had attacked Bose, with Bose uploading a video online showing injuries and alleging an unprovoked assault.

Following Bose’s complaint, Kumar was arrested based on a First Information Report (FIR) filed against him. However, after reviewing CCTV footage from the site, which allegedly showed Bose as the aggressor, the narrative shifted. The footage reportedly captured Bose assaulting Kumar and discarding his phone and personal belongings during the scuffle.

After securing bail, Kumar filed a counter-complaint against Bose, accusing him of attempted murder and other serious charges. In response, Bose approached the High Court, challenging the FIR and the ongoing proceedings before a city court. His petition questioned the applicability of several sections under the Bharatiya Nyaya Sanhita (BNS), including Sections 109 (abetment), 115(2) (attempt to commit an offence punishable with life imprisonment), 304 (culpable homicide not amounting to murder), 324 (voluntarily causing hurt by dangerous weapons or means), and 352 (assault or use of criminal force otherwise than on grave provocation).

While granting limited relief, the High Court ordered that no coercive steps be taken against Bose and directed that no charge sheet be filed without its permission. The court further emphasized that any summons to Bose must strictly adhere to legal requirements and instructed him to cooperate fully with the investigation.

Notices have been issued to the Baiyappanahalli police and Vikas Kumar, and the matter will be heard further in the coming days.
