SC grants Abbas Ansari temporary release for father Mukhtar Ansari’s fatiha ritual

The Supreme Court granted temporary release to MLA Abbas Ansari, who is currently detained in Kasganj jail, to attend his deceased father Mukhtar Ansari's Fatiha ritual. 

The release order issued by Justices Surya Kant and KV Vishwanathan, mandates Abbas to be escorted from Kasganj jail to his hometown under police custody with appropriate security measures in place. The Director General of Police has been directed to oversee the required arrangements.

The court's decision comes after Abbas Ansari's plea to attend his father's funeral, filed originally but subsequently amended to seek permission for the Fatiha ritual scheduled for April 10th. Despite objections from the State of Uttar Pradesh citing Abbas's criminal record and concerns of witness tampering if granted bail, the bench found merit in allowing Abbas to participate in this familial obligation.

The State argued that Abbas Ansari, being a history-sheeter with multiple pending cases and a purported leader of a gang within Chitrakoot jail, should not be granted leniency. However, the court was convinced that denying Abbas permission to attend his father's ritual would be unjustified.

Abbas Ansari's father, Mukhtar Ansari, a prominent figure known for his transition from gangster to politician, passed away due to cardiac arrest in a Banda hospital on March 28th. Following Mukhtar Ansari's death, concerns regarding his medical treatment prior to demise have been raised by his elder brother, Sibgatullah Ansari.

In parallel to these legal proceedings, a separate investigation is underway as the Chief Judicial Magistrate of Banda has ordered a thorough magisterial probe into the circumstances surrounding Mukhtar Ansari's demise. This investigation includes a post-mortem examination by a panel of doctors, to be documented via video recording, aiming to ascertain the events leading to his passing.
