SC Declares 'Cannot Ask CM Mamata Banerjee to Resign' During Suo Motu Hearing on Kolkata Doctor's Death

A visibly displeased Chief Justice of India sternly addressed a counsel presenting a plea demanding the resignation of the West Bengal Chief Minister in light of the recent events at RG Kar Medical College and Hospital.

"Sir this is not a POLITICAL FORUM..you are a member of the Bar, we don't require your affirmation to what we say..WE ARE NOT HERE TO SEE WHAT YOU FEEL ABOUT A PARTICULAR POLITICAL FUNCTIONARY..that is not our concern..", the CJI said at the outset.

As the counsel proceeded with his submissions, Chief Justice Chandrachud reminded the lawyer that it is beyond the court's jurisdiction to direct a Chief Minister to resign.

"You please listen to me..otherwise I will have you removed from court..", the CJI said as a last warning before the counsel decided to stop with his submission.

Earlier today, during the suo motu hearing, Senior Advocate Kapil Sibal urged the Supreme Court to reconsider its decision to live stream the proceedings, citing the high emotional implications of cases like the one concerning the incident at RG Kar Medical College.

The Supreme Court has been hearing this suo motu case, which was registered following the brutal rape and murder of a young doctor at the Kolkata medical college on August 9, 2024. The Central Bureau of Investigation (CBI) took over the investigation after the Calcutta High Court transferred the case from the state police due to a lack of progress and concerns about possible evidence tampering.

The incident has sparked widespread outrage, leading to protests from doctors and prompting the Supreme Court to establish a National Task Force to develop protocols for ensuring the safety and protection of women doctors across the country. 

The Supreme Court took cognizance of the issue after receiving letter petitions urging the Chief Justice of India to initiate suo motu proceedings and ensure an impartial investigation into the attacks on protesting doctors at RG Kar Medical College. 

The victim, a 31-year-old junior doctor, was found dead in a seminar hall at the hospital. The CBI has registered an FIR based on the initial police report, which includes charges of rape and murder.
