Sanjay Singh's defamation plea dismissed by SC over remarks on PM Modi's degree

On Monday the Supreme Court of India refused to entertain the plea filed by Aam Aadmi Party (AAP) Member of Parliament (MP) Sanjay Singh concerning the summons issued to him in a defamation case. The case revolves around remarks made by Singh regarding Prime Minister Narendra Modi's academic degree.

During a brief hearing, a bench comprising Justices BR Gavai and Sandeep Mehta addressed Singh's challenge to a Gujarat High Court order. The bench stated, "All this is a matter of defence. In fact, the High Court has already observed that all contentions available to the parties are kept open. 

The learned Trial Judge would not be influenced by any of the observations made in the impugned order." The apex court directed Sanjay Singh to pursue the matter through the trial court, as he had approached the Supreme Court after the Gujarat High Court denied him relief.

Senior Advocate Rebecca M John represented Sanjay Singh during the hearing. John argued that, "The Gujarat University was not defamed or named, but the video is not uploaded by me. How is Gujarat University affected? I have not uploaded any video on Twitter, and Twitter should be asked to verify that. Strangely, all witnesses are from the university itself."

Senior Advocate Abhishek Manu Singhvi also presented arguments on behalf of Sanjay Singh, emphasizing that "Complaint can't be filed by Gujarat University and can be filed by prosecution only. It's a finding that Gujarat University is a state. A Section 499 complaint is barred."

The defamation complaint in question was filed by Dr. Piyush M Patel, the registrar of Gujarat University. The complaint targeted both Sanjay Singh and Delhi Chief Minister Arvind Kejriwal for allegedly making defamatory statements in press conferences and on Twitter handles, targeting the university over the Prime Minister's degree.
