Petitioners Call for Open Court Hearing in 'Marriage Equality' Review Request Before Supreme Court

The petitioners who sought a review of the 'Marriage Equality' decision requested an open court hearing from the Supreme Court for their petition.

Senior Advocate NK Kaul, representing one of the review petitioners, urged Chief Justice DY Chandrachud to consider holding the review petition hearing in open court rather than in chambers, emphasizing the significant public interest involved in the matter.

"We would humbly request would Your Lordships consider that in public interest these hearings could happen in open court, my lords?"

However, the Chief Justice of India noted that traditionally, review petitions are heard only in chambers.

It is noteworthy that on July 10, the Supreme Court is slated to review its earlier decision in Supriyo v. Union of India, where it declined to recognize same-sex marriages as legally valid.

The review petitions will be heard by a newly constituted bench, as two of the judges from the original 5-judge bench, namely Justices Sanjay Kishan Kaul and S. Ravindra Bhat, have retired since delivering the judgment.

Justices Sanjiv Khanna and BV Nagarathna replace the retired members of the bench. The other judges are Chief Justice of India DY Chandrachud, Justice Hima Kohli and PS Narasimha.
