Petition Filed in Delhi High Court Alleging PM Modi Sought Votes Using Hindu and Sikh Deities

In a petition filed in the Delhi High Court, Anand S Jondhale, a lawyer by profession, has sought action against Prime Minister Narendra Modi. The petition alleges that the Prime Minister sought votes for the Bhartiya Janata Party (BJP) by invoking Hindu and Sikh deities and places of worship.

Jondhale is also seeking a directive from the Delhi High Court to the Election Commission of India (ECI) to disqualify the Prime Minister from participating in elections for a period of six years under the Representation of Peoples Act. Additionally, the petition requests a restraining order against the Prime Minister, preventing him from soliciting votes in the "name of religious deities and places of worship."

Jondhale's grievance stems from Prime Minister Modi's speech delivered on April 9 in Uttar Pradesh. The petitioner contends that during this address, the Prime Minister not only solicited votes by invoking Hindu and Sikh deities and their places of worship but also made remarks against "opposite political parties as favoring Muslims."

The plea emphasizes the urgency for the Election Commission of India (ECI) to take immediate action against the Prime Minister, highlighting the impending Lok Sabha polls. It argues that such action is crucial for ensuring fair elections, especially considering the rapidly approaching voting date.

“That the Petitioner further submits that the Respondent No.2 (Prime Minister Modi) is on the run of making the same violative speech throughout India while travelling in aircrafts and helicopter of Government of India,” the plea states.

Jondhale asserts that the Prime Minister's speeches possess the potential to sow seeds of hatred among voters along the lines of caste and religion. Therefore, he advocates for action to be taken against the Prime Minister in accordance with the Model Code of Conduct.

Jondhale states that earlier this month, he lodged a complaint with the Election Commission of India (ECI) urging for an FIR to be filed against PM Narendra Modi under Section 153A of the Indian Penal Code. Additionally, he called for the Prime Minister's disqualification from elections for six years under the Representation of the People Act, 1951, with immediate effect. However, Jondhale alleges that to date, the ECI has not taken any action on the matter.
