Madhya Pradesh HC Orders Investigation into BJP Minister's Alleged Role in Inciting Communal Riots

The Madhya Pradesh High Court has issued a directive to the Station House Officer of Tilaknagar Police Station, instructing them to proceed with necessary actions regarding the complaint filed by Congress Spokesperson Aminul Khan Suri against BJP Minister Kailash Vijayvargiya.

The complaint alleges Vijayvargiya's dissemination of a misleading video on X (previously known as Twitter), purportedly aimed at fueling the communal unrest that arose in Khargone during the Ram Navami Procession in April 2022.

Justice Pranay Verma, presiding over a single-judge bench, has instructed that the police must undertake suitable action, taking into account Aminul Khan Suri's complaint, within a span of 90 days. Additionally, it is incumbent upon the police to inform the complainant of the complaint's status following thorough examination.

“…The petitioner is directed to furnish within a period of 7 days from today proof before the Station House Officer Police Station Tilak Nagar, District Indore, as regards the filing of the complaint by him on 16/4/2022”, the bench sitting at Indore further added as a precondition for consideration of the complaint.

Relying on the precedent set by the case of Rajendra Singh Pawar & Ors. v. State of M.P. & Ors. (2021), the court reiterated the essential procedures that the relevant police officer must adhere to during the examination of the complaint and the subsequent preliminary inquiry process.

The police officers are required to process the complaints received by them within 15 days. If the officers are unable to do so, they are expected to take action on the complaint within a maximum period of 42 days after receiving the complaint, the court reproduced the relevant excerpt from Rajendra Singh Pawar.

After citing the aforementioned reasons, the court resolved the writ petition.
