The Jharkhand High Court has recently ruled in favor of a man who was wrongfully detained by the police. The Court directed the State government to pay ₹5 lakh in compensation to the petitioner, Mr. Ajit Kumar, who was found not guilty of the charges brought against him. The Court also ordered the registration of a First Information Report (FIR) against the responsible police officers.
Justice Sanjay Kumar Dwivedi highlighted the negligence of the police officers involved and stated that their carelessness resulted in the petitioner being deprived of his liberty. The Court recognized the violation of the petitioner's fundamental rights and deemed the compensation justified under Article 21 of the Constitution of India.
The compensation can be recovered from the salaries of the erring police officers. While it cannot fully undo the trauma and humiliation suffered by the petitioner, it provides some consolation and helps him move forward.
During the hearing, the petitioner's counsel emphasized the brutal torture inflicted on Mr. Kumar and his co-accused. The police admitted their mistake, and the Court discharged the petitioner after a final report acknowledged his innocence.
The Court lamented the loss of the petitioner's bright future due to the careless actions of the State Police. The case serves as an example of justice prevailing and upholding individuals' rights.
The case, titled Ajit Kumar v. State & Ors, highlights the power of the judicial system in rectifying wrongful detentions.
Advocates Sumit Prakash, Ravi Shanker Prasad, and Akash Deep represented the petitioner, while Advocates Manoj Kumar and Deepankar represented the State. Advocates Manoj Tandon, Neha Bhardwaj, and Adamya Kerketta represented the erring police officer.
