'Granting bail in case of human trafficking will send a wrong message' : Delhi HC

While rejecting the bail plea of the accused, who raped a 12-year-old minor by bringing her to Delhi in the name of getting new clothes and a mobile phone, the Delhi High Court said that granting bail in a human trafficking case will send the wrong message to society.

The court said that the victim was studying when this incident happened.

The court said that interruptions in studies affect his entire life. The court also said that the matter is not that the victim has not testified against the accused, but that she is not capable of testifying due to human trafficking and physical exploitation.

While refusing to grant bail, a bench of Justice Swarn Kanta Sharma said that in such an incident where the entire life of the victimized young girls is changed, it is their duty to ensure that the accused are not granted bail. The court said that the present case not only involves a serious incident of sexual exploitation of a 12-year-old minor, but also reveals the grave reality of human trafficking and exploitation of persons for exploitation.

In the case of such a heinous crime, the basis for bailing the accused is also to ensure the safety of society and justice for the victims of such heinous crimes. According to the petition, the accused had brought the victim to Delhi from Jharkhand. When the concerned DCP presented herself before the magistrate on August 3, 2022, she could not communicate properly due to grief, anxiety, and despair.

It is alleged that the accused asked her to go to Delhi in the name of getting clothes and a mobile phone. When she refused, he forcefully brought her from Ranchi to Delhi. He employed the victim here, but did not pay her any salary. When she protested, he took her to his house in Jarela and raped her.
