The Delhi High Court has taken action by issuing a notice in response to a plea seeking more space for the expansion of courtrooms, lawyers' chambers belonging to the Delhi High Court Bar Association (DHCBA), and parking facilities.
Acting Chief Justice Manmohan and Justice Manmeet PS Arora, forming a division bench, have requested a response from the Union of India, including the Ministries of Housing and Urban Affairs, Law and Justice, as well as the Registrar General of the High Court, within a timeframe of eight weeks.
"Let's start by issuing the notice and obtaining a report from the Registrar General. Once we have that information, we can proceed accordingly. However, the primary requirement is securing the land. Currently, the High Court is constrained by lack of sufficient land. This issue needs our immediate attention, and we will address it accordinglyy," ACJ said.
The petition, initiated by the Delhi High Court Bar Association (DHCBA), urges the Centre to allocate the entirety of Bapa Nagar in the national capital for infrastructural purposes. This entails relocating the current residents of the residential quarters to newly constructed flats under the GPRA Scheme.
The petition has been filed by Advocates Nitesh Mehra and Siddharth Tripathy. It highlights that the workload of the Delhi High Court has significantly escalated over the years, consequently leading to a substantial increase in the number of advocates. Currently, there are approximately 35,000 lawyers registered as members of the Delhi High Court Bar Association, underscoring the pressing need for expanded infrastructure.
The plea argues that the Delhi High Court faces a shortage of space to accommodate additional courtrooms, lawyers' chambers, modern libraries, canteens, parking facilities, bar rooms, and amenities for litigants.
Furthermore, the plea highlights that a representation was submitted to the authorities in July of the previous year, emphasizing the urgent need for infrastructural space to facilitate the expansion of the Delhi High Court, as well as the Delhi High Court Bar Association.
However, the plea asserts that despite the representation made, no steps have been taken by the authorities to address the urgent need for infrastructural expansion.
The plea further emphasizes that the provision of a dignified working space is not only essential for the effective administration of justice, in line with the rule of law, ensuring the dignity of all stakeholders involved in the legal process, but also crucial for upholding the principles of the rule of law and personal dignity.
