The Delhi High Court has mandated that the Delhi Government establish the Delhi Pharmacy Council within a strict two-week deadline, presenting it as the final and definitive chance to do so. The bench of Justice Prathiba M Singh was dealing with a petition filed by members of the Delhi Pharmacy Council regarding the notification of the election results for the Council, which took place on November 02, 2021.
“Considerable delay has already taken place in the constitution of the Delhi Pharmacy Council. The writ petition itself relates to notifying the results of election of the Delhi Pharmacy Council held on 2nd November, 2021. Since the newly elected body now stands notified, the Respondent No. 1-GNCTD shall constitute the Delhi Pharmacy Council within two weeks as a last and final opportunity,” the court said.
The Court had noted significant disparities last month between the vote count and the figures listed in the election results notification. It was brought to the court's attention that the Delhi Government rectified this by issuing a corrected notification on October 12.
In February, the petition was resolved, and a directive was issued to declare the election results within three weeks. The court emphasized that administrative delays within government departments should not be used as a justification for prolonging the process.
Subsequently, an application was filed requesting instructions to establish the Council since it had not been constituted, and errors were found in the notification of the election results issued by the Delhi Government.
