The Gwalior bench of Madhya Pradesh High Court, while hearing the murder case, gave some suggestions to complete the trial of the case expeditiously. Justice Anand Pathak said that in many cases, if the summons arrives late, the hearing also gets delayed.
He suggested that every police station, especially the investigating officer of the case, should create a WhatsApp group for every case, in which the complainant, witness, court clerk, investigating officer of the case, clerk of the concerned court and prosecution officer should be added. .
This will make it easier to send summons during the hearing. Apart from this, information about the date on which the hearing is to be held and which person is to be present in it will also be clear. The High Court also made it clear that this type of WhatsApp group should be kept completely confidential.
In order to keep the identity of the victim confidential in POCSO and juvenile cases, Justice Pathak suggested that in such cases, instead of including women and juveniles in the WhatsApp group, a male member of their family should be included.
Explaining another advantage of this group, the High Court said that it has been seen many times that witnesses related to the case are threatened or unnecessary pressure is put on them. If such a situation occurs, the witness will immediately put the information in the WhatsApp group, so that everyone from the investigating officer to the court will get the information.
In the end, Justice Pathak said that special care should be taken that as soon as the trial of the case is over, the concerned WhatsApp group should be dissolved. As soon as the purpose of creating the WhatsApp group is accomplished, it will have to be ended.
