CJI Sanjiv Khanna Considers Lawyer's Request for Adjournments via Letter Circulation

Today, newly sworn-in Chief Justice of India, Sanjiv Khanna, expressed his will to consider a lawyer's request to permit adjournment requests through letter circulation. Additionally, the CJI agreed to review the request for the publication of physical causelists.

Last year, in December the Supreme Court temporarily prohibited the practice of seeking adjournments through letter circulation.

Subsequently, in February of this year, the Court introduced a new procedure, under which adjournment requests via letter would not be accepted in certain cases. These include matters related to bail or anticipatory bail, where exemption from surrendering is sought, cases with interim orders favoring the party requesting more time, and cases involving suspension of sentence. The circulation of adjournment letters has also been prohibited in fresh and regular hearings. However, in other matters, adjournment letters may be circulated up to one day before the publication of the main list.

Under these guidelines, parties or counsel are allowed to circulate adjournment letters only once, and consecutive adjournments without court listing are not permitted. Matters that are adjourned in accordance with these rules will be scheduled for hearing before the court within a maximum of four weeks, with a specific date assigned for the hearing.
