Accused absconded for 22 years, HC grants bail, SC issues notice to cancel

The bench of Justices Hrishikesh Roy and Sanjay Karol has issued notice on a petition filed by the complainant against an order of the High Court suspending the sentence of an accused who absconded for more than 22 years.

The bench noted in the order issuing notice that the incident took place in 1998 and Respondent no.2, the prime accused in the offence, absconded. The charge sheet was submitted under section 299 CRPC. After that, the accused was arrested in the year 2020.

The trial court convicted the accused for life imprisonment, the appeal filed by the accused was admitted and his application for Suspension of Sentence was allowed.

The Accused had undergone only 3 years of incarnation when he was sentenced to life imprisonment.

Accused Shreeram was the principal accused in the case who inflicted injuries to the deceased with a sharp-edged weapon. The deceased sustained 12 injuries of which the first blow was given by the present accused.

The SLP of the Complainant was filed by Advocate on Record Rishi Matoliya.
