Will Right to dress include Right to undress: Supreme Court in Hijab hearing

Justice Hemant Gupta if the Supreme Court asked a lawyer arguing for the right to wear hijab in educational institutions: "You can't take it to logical ends. Rights to dress will include right to undress too?"

Sr. Adv. Dev Dutt Kamar replied, "Nobody is undressing in a school."

This was part of the longer discussion between the judges and lawyer, during which justice Hemand Gupta also said, "Problem here is that one particular community is insisting on a headscarf (hihab) while all other communities are following the dress code, Students of other communities are not saying we want to wear this and that."

When Advocate Kamat said many students wear Rudraksha or Cross as religious symbols and Justice Gupta responded "That is worn inside the shirt. Nobody is going to life the shirt and see if someone is wearing Rudraksha."

The bench further said "You may have the religious right to practice whatever you want to practice but can you practice and take that right to a school which has uniform as part of dress you have to wear? That will be the question."

The Court further said "The issue can be modulated little bit in a different way. It may be essential, it may not be essential."
