On Wednesday (January 18) in the Supreme Court, there was a heated exchange between Justice Dinesh Maheshwari and Senior Advocate and Supreme Court Bar Council President Vikas Singh. Justice Maheshwari expressed displeasure over the behavior of Advocate Vikas Singh. The debate between the two continued for a long time. In fact, after hearing the fresh cases, the bench of Justice Dinesh Maheshwari and Justice Bela Trivedi started hearing the cases which were left incomplete a day earlier.
Advocate Vikas objected to this while interrupting. On which Justice Dinesh Maheshwari said that it was already mentioned in the list that after hearing the fresh matters, the matters of the supplementary list would be heard. But even after this, Vikas Singh kept on arguing. Advocate Vikas Singh said that there is such a problem in three courts. If there is any pending hearing, then it should also be shown in the list. On this, Justice Maheshwari said that these are the same cases of the supplementary list which were shown on the board yesterday.
Advocate Vikas Singh said that being the President of the Bar Association, it is my duty to draw your attention towards any problem or lacuna. On this, Justice Dinesh Maheshwari replied that "did we keep on explaining the same thing to you again and again? You haven't personally verified the entire matter have you? You are the senior most member of the Bar Association, so we expect more from you.:"
The heated exchange between Justice Dinesh Maheshwari and Advocate Vikas Singh did not stop here. Vikas Singh said that I will not keep searching as to which case's hearing was left incomplete a day ago. Such cases should be kept in today's list as well. I have been practicing in this court for 32 years, but a new problem is being seen. On this, Justice Maheshwari said that "if yesterday's incomplete case is being heard today, then what is the problem in it? We are not able to understand…."
Justice Maheshwari further said that, "you said that we suddenly jumped into another matter. While it is clearly written in the list that after the fresh cases, such cases will be heard, which were left incomplete. You should become more responsible. This is so amazing..."
Advocate Vikas Singh said that "you are getting very furious, please hear the matter.."
Justice Maheshwari became more angry on this. He said "that you are using a word like exhausted. In this way no one is expected to interrupt. We will do whatever we feel is necessary. Expect more responsibility before any comment from a senior person like you. You are not aware of the facts and neither are you ready to accept it. It seems that whoever gave you the information. He didn't tell the whole thing."
However, later when Justice Maheshwari started getting up before lunch, another senior advocate V. Giri expressed regret over the whole matter and said that we are also pained that this happened in the court. On this Justice Maheshwari said that "I will retire in 3-4 months. Never faced such behavior in last 19 years. There should always be respect towards the institution. There is a way to keep your point... There is no personal issue."
Justice Bela Trivedi also said that "senior lawyers should be more disciplined."
It is to be noted that in the last week Sr. Adv. Vikas Singh had a similar kind of heated exchange of talks with the Chief Justice of India Dr. DY Chandrachud.
