Uttarakhand High Court rejects appeal seeking govt employees to get grade pay from January 1, 2013

Today, the Uttarakhand High Court upheld the order of the single bench and rejected the special appeal of the government. The single bench had passed an order to give the benefit of grade pay to third cadre ministerial employees working in non-government aided schools from January 1, 2013.

On Thursday, the government's special appeal was heard in the division bench of Chief Justice Vipin Sanghi and Justice Alok Kumar Verma. 

Single bench passed an order to give the benefit of grade pay to all the non-government aided ministerial employees working in Uttarakhand from October 20, 2016, whereas this benefit was given to the ministerial employees working in government schools from January 1, 2013. 

Narayan Dutt Pandey and others had filed a petition in the High Court on behalf of the Govt employees working in non-government schools. While giving decision in favor of the employees, the single bench had given instructions to give this benefit to the employees from January 1, 2013.

The Council for petitioner's submitted that this benefit is already being given to teachers and class IV employees in non-government aided secondary schools. The government had challenged this order of the single bench by filing a special appeal in the High Court. The division bench rejected the special appeal of the government and accepted the order of the single bench as correct.
