Umar Khalid withdraws bail plea in SC: Delhi Riots Case takes another turn

Umar Khalid, a prominent activist and former student leader, has withdrawn his bail plea from the Supreme Court in connection with the Delhi riots conspiracy case, citing a change in circumstances. Khalid has been in detention since September 2020, facing charges including criminal conspiracy, rioting, unlawful assembly, and offenses under the Unlawful Activities (Prevention) Act (UAPA).

The decision to withdraw the bail plea came during a scheduled hearing before a bench comprising Justices Bela M Trivedi and Pankaj Mithal. Senior Advocate Kapil Sibal, representing Khalid, informed the court of the withdrawal, stating, "We wish to withdraw due to a change of circumstances and move the trial court for appropriate relief."

Khalid's legal battle has been protracted and marked by several twists and turns. A Karkardooma court had denied him bail in March 2022, following which he approached the High Court, which also refused to grant him relief in October 2022. Subsequently, Khalid filed an appeal before the Supreme Court.

The Supreme Court initially sought the response of the Delhi Police in May 2023. However, the plea was adjourned multiple times, causing delays in the legal process. The last adjournment, on January 10, was granted as a 'final' adjournment after both parties requested it. Despite efforts by the court to expedite proceedings, various factors, including scheduling conflicts and recusals, contributed to further delays.

In July 2023, the bench hearing the matter expressed its intention to conclude the hearing swiftly, but the process was hindered by subsequent developments. Notably, in August 2023, Justice Prashant Kumar Mishra recused himself from the case, leading to further postponements.

Efforts to expedite the hearing were evident in the court's decision to adjourn the matter to non-miscellaneous days, known for lengthy hearings, in August 2023. However, the case continued to be subject to multiple adjournments until Khalid ultimately withdrew his bail plea in February 2024.

The withdrawal of the bail plea marks a significant development in Khalid's legal battle, shifting the focus back to the trial court where he intends to seek relief. The decision underscores the complexities and challenges inherent in navigating the legal system, particularly in high-profile cases with far-reaching implications.
