Two individuals, adherents of the Muslim faith, are facing charges for attempting to employ the prohibited practice of instant triple talaq as they sought to divorce their wives outside a Delhi court.
The police, in an official statement, have reported the initiation of two distinct First Information Reports (FIRs) against the two men involved in the aforementioned incident.
In the initial case, the woman submitted that she and her sister had visited Delhi's Tis Hazari Court to participate in proceedings concerning maintenance. Following the hearing, the woman claimed that her husband uttered "talaq" three times outside the courtroom. The police stated that they lodged the case following a preliminary investigation. Notably, the woman involved in the incident holds a Doctorate in Chemistry.
In the second instance, a 24-year-old woman informed the police that she entered into matrimony in February 2021 in Mumbai. However, she subsequently returned to her parents' residence in Delhi, citing purported harassment by her in-laws as the reason.
Subsequently, she filed a petition in court seeking maintenance. During the court proceedings, she asserted that when she and her family members were present, her husband also appeared and declared "talaq" three times outside the courtroom.
In August 2019, the practice of triple talaq was prohibited. This practice, where Muslim men would instantly divorce their wives by uttering "talaq" thrice, became illegal. The legislation designates "triple talaq" as a punishable offense, carrying a potential jail term of up to three years and imposing a fine on the husband. Furthermore, the law ensures that the woman is entitled to maintenance in such cases.
