'This is Not a Coffee Shop' , CJI Scolds Lawyer for Saying 'Ya.. Ya..' in Court

During a hearing on Monday, Chief Justice of India (CJI) DY Chandrachud expressed his frustration when a lawyer interjected with "ya.. ya.." in English. He reprimanded the lawyer, stating,

"This is not a coffee shop. What is this? I am very allergic to such remarks. This cannot be tolerated. Please respond appropriately."

After listening to the scolding, the lawyer told that he is a resident of Pune. He started giving arguments in Marathi, on this the CJI also tried to explain to him in Marathi.

The petition in question sought an in-house investigation against former Chief Justice Ranjan Gogoi. During the hearing, CJI DY Chandrachud instructed the lawyer to refrain from mentioning the Chief Justice's name in relation to the case. He emphasized the need for decorum in the courtroom, expressing his disapproval of casual remarks.

The initial lawyer was reprimanded by CJI DY Chandrachud for his casual use of English during the hearing. The Chief Justice emphasized that such informal remarks were inappropriate for the courtroom, particularly in the context of a petition seeking an in-house investigation against former Chief Justice Ranjan Gogoi. CJI Chandrachud instructed the lawyer to avoid mentioning the Chief Justice's name in the case and called for a more respectful tone.

Advocate: Former Justice Ranjan Gogoi's decision was not a valid termination.

CJI Chandrachud: But is this an Article 32 petition? How can you file a PIL by making a judge a party?

Advocate: Ya..ya.. Then CJI Ranjan Gogoi asked me to file a curative.

CJI Chandrachud: This is not a coffee shop! What is this or...or... I am very allergic to it. This cannot be allowed.

CJI : ''जज आला पार्टी करत नहीं। तासा कारण है। (आप किसी जज पर आरोप नहीं लगा सकते। कानून में इसके लिए प्रक्रिया है) जब आप किसी हाईकोर्ट के फैसले को चुनौती देते हैं तो आप यहां जज को दोष नहीं देते।''

The advocate responded, "Main kay karat saheb?" (What should I do?).

CJI Chandrachud: Will you remove Justice Gogoi's name in the appeal.

Advocate: Ho ho (yes..yes..) I will do that.

The petition filed against former CJI Ranjan in 2018 was filed against the former CJI in May 2018. It said former CJI Gogoi had wrongly dismissed a petition challenging his termination under labor laws on the basis of an illegal statement. There were major errors in his judgment.

During the hearing, CJI Chandrachud said that whether right or wrong, the final decision of the Supreme Court has come. The review petition has been rejected. Now you have to file a curative, but you don't want to do that.

The CJI also made it clear that when a High Court decision is challenged in the Supreme Court, the High Court judge who gave the decision in the case is not made a party.
